Government lawyers have conceded Immigration Minister Chris Bowen's duty to act in the interests of asylum-seeker children could be a constraint to implementing Australia's migration laws.
The High Court also heard yesterday it was ''not the purpose'' of the Government's legislation to ensure asylum-seekers would be as well protected in Malaysia as they would be in Australia.
The full bench of the High Court reserved its decision on a legal challenge to the Federal Government's so-called people swap with Malaysia.
