The Federal Government will argue it is not compelled to assess the claims of asylum-seekers on Australian soil - only to provide them with protection and ensure they are not forced back to their homelands, the High Court heard yesterday.
The Government is defending its controversial people-swap deal with Malaysia in a hearing before the full bench of the High Court that will resume today at 10am.
Debbie Mortimer SC, who is acting for the asylum-seekers, yesterday told the court that once the asylum-seekers were sent to Malaysia they could be subject to assaults and the deprivation of their liberty.
